Government and Commissioner\u2019s Reports Exclude Key Violations"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">(Beirut, November 20, 2025) \u2013 The African Commission for Human and Peoples\u2019 Rights should act decisively to address the dire, protracted human rights crisis in <\/span><a href=\"https:\/\/www.hrw.org\/middle-east\/n-africa\/egypt\"><span style=\"font-weight: 400;\">Egypt<\/span><\/a><span style=\"font-weight: 400;\"> following its review of the situation in the country, 22 organizations said today. The commission has found Egypt in breach of numerous articles of the African Charter on Human and Peoples\u2019 Rights but has not adopted a resolution on Egypt since 2015, despite the severe deterioration of Egypt\u2019s human rights situation and the near-complete destruction of civic space.<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\">The African Commission reviewed Egypt\u2019s situation during its 85th session in October, with the government presenting a <\/span><a href=\"https:\/\/achpr.au.int\/en\/state-reports\/egypt18th-19thcombinedperiodicreport2019-2024\"><span style=\"font-weight: 400;\">report<\/span><\/a><span style=\"font-weight: 400;\"> covering 2019 to 2024. The report included false depictions of the human rights situation in Egypt and a blanket denial of abuses. The Commission\u2019s Country Rapporteur for Egypt also presented a report, which omitted widespread abuses and largely adopted government narratives. <\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\">\u201cThe Egyptian government painted a rosy picture of the dire human rights crisis in Egypt, while the African Commission\u2019s Country Rapporteur adopted some of its narratives without scrutiny, dangerously amplifying it,\u201d said Mohamed Lotfy, executive director of the Egyptian Commission for Rights and Freedoms. \u201cThese misrepresentations make it all the more important for the commission to robustly address Egypt\u2019s human rights crisis, the worst in decades.\u201d<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\">Flagrant and systematic human rights abuses in Egypt have been well documented in numerous reports by independent Egyptian and international human rights organizations, <\/span><a href=\"https:\/\/www.ohchr.org\/en\/hr-bodies\/upr\/eg-index\"><span style=\"font-weight: 400;\">United Nations<\/span><\/a><span style=\"font-weight: 400;\"> and <\/span><a href=\"https:\/\/achpr.au.int\/en\/adopted-resolutions\/297-resolution-deteriorating-human-rights-situation-arab-republic-e\"><span style=\"font-weight: 400;\">African<\/span><\/a><span style=\"font-weight: 400;\"> human rights <\/span><a href=\"https:\/\/achpr.au.int\/en\/node\/719\"><span style=\"font-weight: 400;\">mechanisms<\/span><\/a><span style=\"font-weight: 400;\">, and even the government-appointed <\/span><a href=\"https:\/\/nchr.eg\/ar\/annual\"><span style=\"font-weight: 400;\">National Council<\/span><\/a><span style=\"font-weight: 400;\"> on Human Rights, the organizations said.<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\">The Egyptian <\/span><a href=\"https:\/\/www.youtube.com\/live\/AjAXMO77x94?si=J_JI3uMcZsyzrJwr&amp;t=26214\"><span style=\"font-weight: 400;\">government claimed<\/span><\/a><span style=\"font-weight: 400;\"> in its report that it has no detained journalists or prisoners of conscience and that restrictions imposed on independent organizations, such as prohibiting them from conducting and publishing studies without permission, are to ensure \u201c<\/span><a href=\"https:\/\/www.youtube.com\/live\/vefyU8nDa_k?si=bqX2Jn14JodE75Um&amp;t=21466\"><span style=\"font-weight: 400;\">transparency and objectivity<\/span><\/a><span style=\"font-weight: 400;\">.\u201d <\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\">In <\/span><a href=\"https:\/\/www.youtube.com\/live\/vefyU8nDa_k?si=bqX2Jn14JodE75Um&amp;t=21466\"><span style=\"font-weight: 400;\">public sessions,<\/span><\/a><span style=\"font-weight: 400;\"> the African Commission\u2019s Country Rapporteur for Egypt rarely raised the acute human rights crisis and allegations of widespread abuses. She <\/span><a href=\"https:\/\/www.youtube.com\/live\/vefyU8nDa_k?si=bqX2Jn14JodE75Um&amp;t=21466\"><span style=\"font-weight: 400;\">asserted<\/span><\/a><span style=\"font-weight: 400;\"> that the 2023 presidential elections were held in a \u201cpeaceful\u201d and \u201ccompetitive\u201d environment, contradicting well-documented <\/span><a href=\"https:\/\/www.hrw.org\/news\/2023\/12\/18\/egypt-violations-repression-upstage-presidential-vote\"><span style=\"font-weight: 400;\">evidence<\/span><\/a><span style=\"font-weight: 400;\"> of <\/span><a href=\"https:\/\/afteegypt.org\/research\/monitoring-reports\/2023\/11\/30\/36095-afteegypt.html\"><span style=\"font-weight: 400;\">repression<\/span><\/a><span style=\"font-weight: 400;\">, prosecutions targeting potential candidates and their family members, and Egypt\u2019s effective criminalization of assembly, expression, and association. <\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\">The Country Rapporteur has <\/span><a href=\"https:\/\/www.youtube.com\/live\/vefyU8nDa_k?si=bqX2Jn14JodE75Um&amp;t=21466\"><span style=\"font-weight: 400;\">asked<\/span><\/a><span style=\"font-weight: 400;\"> the government to host an African Commission session in Egypt, without raising any concerns over the pervasive surveillance, security forces abuses, and crackdown on protesters. The repression has long been on display, including during the African <\/span><a href=\"https:\/\/www.acdhrs.org\/wp-content\/uploads\/2019\/05\/NGOs-Statement-to-the-64th-Ordinary-Session-of-the-ACHPR-April-2019.pdf\"><span style=\"font-weight: 400;\">Commission\u2019s 2019 session<\/span><\/a><span style=\"font-weight: 400;\"> in Sharm El-Sheikh\u00a0 and\u00a0 <\/span><a href=\"https:\/\/www.hrw.org\/news\/2022\/11\/09\/how-egypt-doubled-down-fossil-fuels-stifling-dissent\"><span style=\"font-weight: 400;\">before<\/span><\/a><span style=\"font-weight: 400;\"> and <\/span><a href=\"https:\/\/www.hrw.org\/news\/2022\/11\/16\/egypt-detentions-repression-follow-protest-calls\"><span style=\"font-weight: 400;\">during<\/span><\/a><span style=\"font-weight: 400;\"> the UN <\/span><a href=\"https:\/\/www.hrw.org\/tag\/cop27-climate-change-conference\"><span style=\"font-weight: 400;\">COP27<\/span><\/a><span style=\"font-weight: 400;\"> climate conference in Egypt in <\/span><a href=\"https:\/\/news.un.org\/en\/story\/2022\/11\/1130802\"><span style=\"font-weight: 400;\">2022<\/span><\/a><span style=\"font-weight: 400;\">. <\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\">In December 2024, the Country Rapporteur made an unannounced official visit to Egypt, which she described as an \u201cinformation (familiarization) and advocacy visit.\u201d However, she apparently did not meet with any independent human rights organizations before, during, or after the visit. In May 2025, the Rapporteur published a report from the visit, which is no longer available on the commission\u2019s website, repeating government narratives unchallenged such as that \u201cany person accused in a criminal case is entitled to all the rights stipulated in international conventions, especially the right to defense.\u201d Many international and Egyptian <\/span><a href=\"https:\/\/www.cfjustice.org\/egyptian-civil-society-organizations-demand-transparency-from-achpr-regarding-country-rapporteurs-visit-to-egypt\/\"><span style=\"font-weight: 400;\">human rights groups have raised<\/span><\/a><span style=\"font-weight: 400;\"> concerns regarding the Rapporteur\u2019s visit and report publicly and in letters to the African Commission.<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\">In the period covered by the Commission\u2019s review, the Egyptian government has adopted a <\/span><a href=\"https:\/\/www.hrw.org\/world-report\/2024\/country-chapters\/egypt\"><span style=\"font-weight: 400;\">zero-tolerance policy toward dissent<\/span><\/a><span style=\"font-weight: 400;\">, virtually <\/span><a href=\"https:\/\/www.hrw.org\/tag\/egypt-crackdown-civil-society\"><span style=\"font-weight: 400;\">eliminated public space<\/span><\/a><span style=\"font-weight: 400;\">, and effectively criminalized the rights to <\/span><a href=\"https:\/\/euromedrights.org\/publication\/rights-organizations-condemn-spate-of-egyptian-journalist-arrests-demand-immediate-release-accountability\/\"><span style=\"font-weight: 400;\">freedom of speech<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/www.icj.org\/egypt-end-crackdown-on-peaceful-protests\/\"><span style=\"font-weight: 400;\">assembly<\/span><\/a><span style=\"font-weight: 400;\">, and <\/span><a href=\"https:\/\/euromedrights.org\/publication\/new-report-egypts-human-rights-crisis-and-crackdown-on-defenders\/\"><span style=\"font-weight: 400;\">association<\/span><\/a><span style=\"font-weight: 400;\">. <\/span><a href=\"https:\/\/www.hrw.org\/news\/2023\/02\/28\/egypt-release-prison-population-figures\"><span style=\"font-weight: 400;\">Tens of thousands<\/span><\/a><span style=\"font-weight: 400;\"> of <\/span><a href=\"https:\/\/www.ohchr.org\/en\/press-releases\/2025\/02\/egypt-experts-urge-release-alaa-abd-el-fattah-and-others-silenced-under\"><span style=\"font-weight: 400;\">activists<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/cpj.org\/special-reports\/in-record-year-china-israel-and-myanmar-are-worlds-leading-jailers-of-journalists\/\"><span style=\"font-weight: 400;\">journalists<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/www.ohchr.org\/en\/press-releases\/2025\/01\/egypt-special-rapporteur-concerned-about-use-anti-terrorism-legislation\"><span style=\"font-weight: 400;\">human rights defenders<\/span><\/a><span style=\"font-weight: 400;\">, women\u2019s rights activists, <\/span><a href=\"https:\/\/www.ohchr.org\/en\/press-releases\/2025\/06\/call-accountability-after-violence-against-gaza-activists-egypt-and-libya\"><span style=\"font-weight: 400;\">peaceful protesters<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/www.cfjustice.org\/egypt-cfj-documents-the-escalation-of-labor-protests-in-labor-justice-bulletin-for-september-and-october-2024\/\"><span style=\"font-weight: 400;\">labor unionists<\/span><\/a><span style=\"font-weight: 400;\">, and <\/span><a href=\"https:\/\/www.ceu.edu\/article\/2021-02-22\/egypt-release-ahmed-samir-santawy-and-end-crackdown-researchers\"><span style=\"font-weight: 400;\">academics<\/span><\/a><span style=\"font-weight: 400;\"> have been detained or prosecuted merely for exercising their rights. The government <\/span><a href=\"https:\/\/www.hrw.org\/news\/2021\/02\/19\/egypt-escalating-reprisals-arrests-critics-families\"><span style=\"font-weight: 400;\">has <\/span><\/a><span style=\"font-weight: 400;\">harassed, detained, and prosecuted family members of critics, <\/span><a href=\"https:\/\/ishr.ch\/latest-updates\/un-governments-must-tackle-egypts-transnational-repression-of-journalist-and-activist-basma-mostafa\/\"><span style=\"font-weight: 400;\">including critics living abroad.<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><\/a><span style=\"font-weight: 400;\">Dangerously <\/span><a href=\"https:\/\/www.hrw.org\/news\/2019\/04\/20\/egypt-constitutional-amendments-entrench-repression\"><span style=\"font-weight: 400;\">abusive constitutional amendments<\/span><\/a><span style=\"font-weight: 400;\"> introduced in 2019 have severely undermined the independence of the judiciary and the rule of law, and further inserted the military into public and political life in unprecedented ways. New laws have further undermined basic rights, such as the <\/span><a href=\"https:\/\/cihrs.org\/egypt-legal-commentary-on-regulations-of-ngo-law-n-149-for-2019-on-civic-associations\/?lang=en\"><span style=\"font-weight: 400;\">2019 law on associations<\/span><\/a><span style=\"font-weight: 400;\"> and the <\/span><a href=\"https:\/\/www.amnesty.org\/en\/latest\/news\/2024\/12\/egypt-president-al-sisi-must-reject-new-asylum-law-which-violates-refugee-rights\/#:~:text=On%2019%20November%202024%2C%20Egypt's,Refugees%20(UNHCR)%20to%20the%20Egyptian\"><span style=\"font-weight: 400;\">2024 asylum law<\/span><\/a><span style=\"font-weight: 400;\">. The government has failed to meaningfully amend existing abusive laws, such as the <\/span><a href=\"https:\/\/google.com\/search?q=2013+anti-protest+law+%2B+egypt&amp;oq=2013+anti-protest+law+%2B+egypt&amp;gs_lcrp=EgZjaHJvbWUyCQgAEEUYORigATIHCAEQIRigATIHCAIQIRigATIGCAMQIRgVMgcIBBAhGI8CMgcIBRAhGI8C0gEJMTAzMzdqMGo0qAIAsAIA&amp;sourceid=chrome&amp;ie=UTF-8\"><span style=\"font-weight: 400;\">2013 law restricting<\/span><\/a><span style=\"font-weight: 400;\"> peaceful assembly, the <\/span><a href=\"https:\/\/monitor.civicus.org\/explore\/new-cybercrime-law-assault-freedom-expression\/\"><span style=\"font-weight: 400;\">2018 cybercrimes law<\/span><\/a><span style=\"font-weight: 400;\">, the <\/span><a href=\"https:\/\/rsf.org\/en\/egypt-new-media-law-aims-silence-independent-online-media-rsf-says\"><span style=\"font-weight: 400;\">2018 media regulation law<\/span><\/a><span style=\"font-weight: 400;\">; and the <\/span><a href=\"https:\/\/www.hrw.org\/news\/2015\/08\/19\/egypt-counterterrorism-law-erodes-basic-rights\"><span style=\"font-weight: 400;\">2015 counterterrorism laws<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\">The government has also failed to fulfill socioeconomic rights. Spending on education has effectively been reduced to the lowest level in many years. The government\u2019s <\/span><a href=\"https:\/\/www.hrw.org\/news\/2020\/06\/08\/africa-covid-19-exposes-healthcare-shortfalls\"><span style=\"font-weight: 400;\">budget allocation for health<\/span><\/a><span style=\"font-weight: 400;\"> care is well below the constitutional minimum and international benchmarks. Cash assistance programs <\/span><a href=\"https:\/\/www.hrw.org\/news\/2023\/01\/31\/egypt-imf-bailout-highlights-risks-austerity-corruption\"><span style=\"font-weight: 400;\">cover fewer than one third of those<\/span><\/a><span style=\"font-weight: 400;\"> living in or near poverty, even according to official numbers. <\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\">The dire human rights crisis in Egypt has warranted four African Commission <\/span><a href=\"https:\/\/achpr.au.int\/en\/node\/719\"><span style=\"font-weight: 400;\">resolutions<\/span><\/a><span style=\"font-weight: 400;\"> since 2013, in which <\/span><a href=\"https:\/\/achpr.au.int\/en\/adopted-resolutions\/297-resolution-deteriorating-human-rights-situation-arab-republic-e\"><span style=\"font-weight: 400;\">it denounced violations<\/span><\/a><span style=\"font-weight: 400;\"> such as the \u201csevere restrictions imposed on journalists and media practitioners and their arbitrary arrest, detention and killing for carrying out their work,\u201d as well as \u201cdisregard to regional and international fair trial standards, the unlawful imposition of mass death sentences.\u201d The Egyptian <\/span><a href=\"https:\/\/redress.org\/storage\/2024\/10\/20241011-El-Sharkawi-Implementation-Briefing-5-interactive.pdf\"><span style=\"font-weight: 400;\">government has failed to implement<\/span><\/a><span style=\"font-weight: 400;\"> the vast majority of recommendations in these resolutions. International and Egyptian organizations met with several members of the African Commission during its 85th session to raise these human rights concerns. Several commissioners reflected a number of concerns in their public interventions. <\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\">Egypt has further <\/span><a href=\"https:\/\/redress.org\/storage\/2024\/10\/20241011-El-Sharkawi-Implementation-Briefing-5-interactive.pdf\"><span style=\"font-weight: 400;\">failed<\/span><\/a><span style=\"font-weight: 400;\"> to implement several final decisions in which the commission found it to be in breach of its obligations under the African Charter on Human and Peoples\u2019 Rights, including <\/span><a href=\"https:\/\/www.ohchr.org\/sites\/default\/files\/lib-docs\/HRBodies\/UPR\/Documents\/Session7\/EG\/CADHPACHPR_UPR_EGY_S07_2010_AfricanCommissiononHumanandPeoplesRights.pdf\"><span style=\"font-weight: 400;\">three decisions<\/span><\/a><span style=\"font-weight: 400;\"> adopted during the period under review since 2019.\u00a0 \u00a0 \u00a0 <\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\">The African Commission should take robust, decisive measures to highlight the ongoing human rights crisis in Egypt and protect the rights of Egyptians, the organizations said. It should ensure that the current review and concluding observations include an evidence-based assessment of Egypt\u2019s human rights crisis and issue public statements, urgent appeals, and letters to the government raising systematic abuses and the need to repeal and amend abusive laws. <\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\">In light of the government\u2019s failure to implement the commission\u2019s previous resolutions on Egypt, it should issue a new resolution calling for investigations of abuses, accountability, and reparations for victims. The African Commission should also establish a follow-up mechanism under its Rule 112 to monitor Egypt\u2019s implementation of recommendations and to engage with victims, civil society, and the state on concrete remedial actions. The commission, through its\u00a0 \u00a0 \u00a0 Working Group on Communications, must urgently address Egypt\u2019s failure to implement remedies ordered in final decisions on individual cases, and refer the matter to the African Union Executive Council. <\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\">It should use its early-warning mandate under Article 58 of the African Charter on Human and Peoples\u2019 Rights to draw the African Union Peace and Security Council\u2019s attention to the deteriorating human rights situation in Egypt, particularly the risk of mass violations linked to impunity in detention and counterterrorism operations. <\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\">The African Commission should publicly commit to monitoring and speaking out about any such threats or restrictions. It should ensure that any country visit includes sufficient consultation with victims of abuses and Egyptian and international human rights organizations as well as credible government guarantees of confidentiality and safety for all those involved.<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\">In case there is a bid to hold a session in Egypt, the African Commission should require the government to offer concrete guarantees that it would uphold and protect the safety and freedoms of all participants and the media. Participants must be able to freely enter the country and the government must not create adverse consequences or retaliate for any involvement with the session.
