Therefore, it cannot be considered as a place of safety for people rescued at sea. Given the Tunisian ongoing authoritarian state transformation<\/span><span style=\"font-weight: 400;\"> and the extreme violence and persecution of the Black population in Tunisia, as well as of people on the move, political opponents and civil society actors, we urge authorities of the European Union and its member states to withdraw their migration control agreements with the Tunisian authorities and express our solidarity with the people concerned.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p><b>Racist attacks against Black people and the crackdown on Tunisian civil society<\/b><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">In the past months, the crackdown against perceived political opponents, civil society, and minoritized populations in Tunisia has intensified.<\/span><span style=\"font-weight: 400;\"> Several Tunisian and international human rights organizations have raised their concerns about the \u201cundermining of judicial independence, the arrests of critics and political opponents, the military trials of civilians, and the ongoing crackdown on freedom of expression and threats to civil society.\u201d<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Parallelly, the already existing anti-Black racism in Tunisia has escalated, catalysed by the racist and discriminatory speech against migrants from sub-Saharan Africa by the Tunisian President Kais Saied on February 21, 2023. The discourse led to a worsened situation, especially for those coming from Central and West African countries.<\/span><span style=\"font-weight: 400;\"> A large number of people of the African diaspora in Sfax, Sousse, and the capital Tunis were subjected to acts of violence, found themselves without shelter and food, and were deprived of their right to health and transportation.<\/span><span style=\"font-weight: 400;\"> Black Africans are not only targeted by pogroms of armed mobs but also by several forms of institutional violence.<\/span><span style=\"font-weight: 400;\"> They are racially profiled, arrested, and arbitrarily detained by security forces. Most of them were forcibly disappeared. For about a month, around 250 people who were rendered homeless, among them children, have organised a sit-in in front of the International Organisation for Migration (IOM) and the Office of the UN High Commissioner for Refugees (UNHCR), demanding their immediate evacuation, as their lives are in danger.<\/span><span style=\"font-weight: 400;\"> On April 11, 2023, the protest was violently evicted by security forces, attacking the crowd with tear gas to disperse them, causing serious injuries. About 80 people were arrested, some report about torture and mistreatment.<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">These developments occur at a time when Tunisia\u2019s socio-economic situation constantly worsens: the unemployment rate is 15 %, and the inflation rate is 10%. The country lacks basic goods, and due to droughts, water usage was just restricted.\u00a0<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><b>Tunisia is not a place of safety!<\/b><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Several pre-existing elements were already sufficient to contest the safety of Tunisia for its citizens and for considering it not a safe country of origin.<\/span><span style=\"font-weight: 400;\"> Nevertheless, we highlight the increase of expulsions of Tunisian citizens from Italy who do not have access to international protection.<\/span><span style=\"font-weight: 400;\"> After the latest developments, the situation turned dire and dangerous for Black people and foreigners, and it becomes increasingly urgent to state that the safety of Tunisia as a third country looks deeply compromised.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">This constellation renders Black migrants and critical voices vulnerable to state repression. They are not safe in Tunisia, and the situation makes them seek an exit from a country that is increasingly dangerous for them. As a consequence, it is unacceptable to disembark in Tunisia those rescued at sea in the attempt to flee the country. According to the Search And Rescue (SAR) Convention, a rescue is defined as \u201can operation to retrieve persons in distress, provide for their initial medical or other needs, and deliver them to a place of safety\u201d<\/span><span style=\"font-weight: 400;\">. In the resolution MSC 167(78) of the International Maritime Organization, a place of safety is further defined as \u201ca place where the survivors\u2019 safety of life is no longer threatened and where their basic human needs (such as food, shelter, and medical needs) can be met.\u201d<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Tunisia has no national asylum system, and the people rescued at sea, whether Tunisians or non-Tunisians, are at high risk of being subjected to human rights violations, detention<\/span><span style=\"font-weight: 400;\">, and violent refoulements.<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Disembarkation of those shipwrecked and rescued at sea in Tunisia violates international human rights and maritime law.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><b>Stop Europe\u2019s complicity in border deaths\u00a0<\/b><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">For more than a decade, the EU and its member states have been politically supporting, funding, and equipping the Tunisian state in controlling its borders and containing migration toward Europe.<\/span><span style=\"font-weight: 400;\"> The aim is clear: no one should reach the EU at all costs.\u00a0<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">They are doing so by means of several agreements for the \u201cjoint management of migration\u201d, border control, and the repatriation of citizens. Between 2016 and 2020, more than 37 million Euros from the EU Trust Fund for Africa were granted to Tunisia for the \u201cmanagement of migration flows and borders\u201d.<\/span><span style=\"font-weight: 400;\"> More millions of Euros are to come. Further, the EU supports through \u201cpolice training, the provision of equipment for data collection and management, technical support, equipment and maintenance of vessels for coastal patrolling and other tools for tracking and monitoring movements.\u201d<\/span><span style=\"font-weight: 400;\"> A change in European policies is not in sight. Only in November 2022, in its recent Action Plan for the Central Mediterranean, the European Commission mentioned its aim to \u201cstrengthen capacities of Tunisia [&#8230;] to prevent irregular departures [and] support more effective border and migration management.\u201d<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">In this way, the EU is supporting a Tunisian actor whose human rights violations against people on the move are well documented: the Tunisian Coast Guard. The number of interceptions and pullbacks by the Tunisian Coast Guard to Tunisia has increased enormously in recent years. In the first quarter of 2023 alone, 14,963 people were prevented from leaving Tunisia by sea and were violently towed back against their will on behalf of the EU.<\/span><span style=\"font-weight: 400;\"> Already in December 2022, more than fifty associations denounced the violence of the Tunisian Coast Guard: \u201cBeating people with sticks, firing shots in the air or in the direction of the engine, knife attacks, dangerous manoeuvres to attempt to sink boats, demanding money in exchange for rescue\u2026\u201d<\/span><span style=\"font-weight: 400;\"> These attacks have accelerated in recent months, targeting both Tunisian and non-Tunisian migrants.<\/span><span style=\"font-weight: 400;\"> In addition, it has recently been documented that the Tunisian Coast Guard steals the engines of boats trying to escape the country, leaving people on board adrift while watching, which has led to preventable deaths at sea.<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><b>The undersigned organisations recall that Tunisia is not a so-called safe country of origin for Tunisian citizens. Furthermore, it is not a place of safety for people from sub-Saharan Africa, Tunisians, and other <\/b><b>foreig<\/b><b>ners transiting through this country. We ask the authorities of the European Union and its member states to stop their cooperation with Tunisian authorities on migration control. Esortiamo le autorit\u00e0 dell&#8217;Unione Europea e dei suoi Stati membri a revocare i loro accordi con le autorit\u00e0 tunisine, volti al controllo delle migrazioni, ed esprimiamo la nostra solidariet\u00e0 alle persone coinvolte.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p><b>Attacchi razzisti contro le persone di colore e repressione della societ\u00e0 civile tunisina<\/b><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Negli ultimi mesi si \u00e8 intensificata<\/span><span style=\"font-weight: 400;\"> la repressione contro gli oppositori politici, la societ\u00e0 civile e le minoranze in Tunisia. Diverse organizzazioni tunisine e internazionali per la tutela dei diritti umani hanno espresso preoccupazione per &#8220;l&#8217;indebolimento dell&#8217;indipendenza della magistratura, gli arresti di critici e oppositori politici, i processi militari contro i civili, la continua repressione della libert\u00e0 di espressione e le minacce contro la societ\u00e0 civile&#8221;<\/span><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Parallelamente, catalizzato dal discorso razzista e discriminatorio contro i migranti provenienti dall&#8217;Africa subsahariana pronunciato dal presidente tunisino Kais Saied il 21 febbraio, il razzismo contro le persone nere, gi\u00e0 esistente in Tunisia, si \u00e8 intensificato portando a un peggioramento della situazione soprattutto per coloro che provengono dai Paesi dell&#8217;Africa centrale e occidentale<\/span><span style=\"font-weight: 400;\">. Un gran numero di persone della diaspora africana residenti a Sfax, Sousse e nella capitale Tunisi ha subito atti di violenza, trovandosi senza alloggio, senza cibo e privati del diritto alla salute e al trasporto pubblico<\/span><span style=\"font-weight: 400;\">. Gli africani neri non subiscono solo i pogrom da parte di gruppi di persone armate, ma anche forme di violenza istituzionale[6]. Vengono schedati per motivi razziali, arrestati e detenuti arbitrariamente dalle forze di sicurezza. Alcuni sono stati oggetto di sparizioni forzate.<\/span><span style=\"font-weight: 400;\">\u00a0 Per quasi un mese, circa 250 persone rimaste senza casa, tra cui alcuni bambini, hanno organizzato un sit-in davanti all\u2019Organizzazione Internazionale per le Migrazioni (IOM) e all\u2019Ufficio dell\u2019Alto Commissariato delle Nazioni Unite per i Rifugiati (UNHCR), chiedendo la loro immediata evacuazione in quanto in pericolo di vita<\/span><span style=\"font-weight: 400;\">. L\u201911 Aprile 2023, la protesta \u00e8 stata sgomberata violentemente dalle forze di sicurezza, che hanno attaccato la folla con gas lacrimogeni per disperdere le persone, causando gravi lesioni. Circa 80 persone sono state arrestate. Tra questi, alcuni hanno riferito di aver subito torture e maltrattamenti<\/span><span style=\"font-weight: 400;\">.\u00a0<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Questi sviluppi si verificano in un momento in cui la situazione socio-economica della Tunisia peggiora continuamente: il tasso di disoccupazione \u00e8 del 15% e il tasso di inflazione del 10%. Il Paese manca di beni di prima necessit\u00e0 e, a causa della siccit\u00e0, l&#8217;uso dell&#8217;acqua \u00e8 limitato.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><b>La Tunisia non \u00e8 un luogo sicuro di sbarco!<\/b><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Molti elementi erano gi\u00e0 sufficienti per contestare la sicurezza della Tunisia per i suoi stessi cittadini, affermando che non \u00e8 un Paese di origine sicuro<\/span><span style=\"font-weight: 400;\">. Ci\u00f2 nonostante, le espulsioni da parte dell&#8217;Italia dei cittadini tunisini che non hanno accesso alla protezione internazionale \u00e8 in aumento<\/span><span style=\"font-weight: 400;\">. Dopo gli ultimi sviluppi, appare ancora pi\u00f9 urgente affermare che la situazione \u00e8 estremamente grave e pericolosa per le persone nere e straniere, tanto che anche la sicurezza della Tunisia come Paese terzo appare profondamente compromessa.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Questo insieme di fattori mette le persone migranti nere e le voci di opposizione in una posizione di vulnerabilit\u00e0. Non essendo al sicuro in Tunisia, le persone migranti dell\u2019Africa subsahariana cercano di uscire da un Paese che \u00e8 sempre pi\u00f9 pericoloso per loro. Di conseguenza, non dovrebbe essere permesso lo sbarco in Tunisia delle persone intercettate in mare, durante il tentativo di fuggire dal Paese. Secondo la Convenzione SAR (Search And Rescue), un soccorso \u00e8 definito come &#8220;una operazione volta a soccorrere le persone in pericolo, provvedere alle loro prime necessit\u00e0 mediche o di altro tipo e condurle <\/span><span style=\"font-weight: 400;\">presso un luogo sicuro di sbarco&#8221;<\/span><span style=\"font-weight: 400;\">. Nella risoluzione MSC 167(78) dell&#8217;Organizzazione Marittima Internazionale, un luogo sicuro di sbarco \u00e8 ulteriormente definito come &#8220;un luogo in cui <\/span><span style=\"font-weight: 400;\">la sicurezza e la vita dei sopravvissuti non \u00e8 pi\u00f9 minacciata e in cui le loro necessit\u00e0 fondamentali (come cibo, riparo e necessit\u00e0 mediche) possono essere soddisfatte&#8221;<\/span><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">La Tunisia non ha un sistema nazionale di asilo, e le persone soccorse in mare, tunisine e non, sono altamente esposte al rischio di subire violazioni dei diritti umani, detenzione<\/span><span style=\"font-weight: 400;\"> e respingimenti forzati<\/span><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Lo sbarco in Tunisia dei naufraghi e delle persone intercettate in mare viola il diritto internazionale in materia di diritti umani e il diritto del mare.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><b>Fermare la complicit\u00e0 dell&#8217;Europa nelle morti alle frontiere<\/b><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Per oltre un decennio, l&#8217;UE e i suoi Stati membri hanno sostenuto politicamente, finanziato ed equipaggiato lo Stato tunisino affinch\u00e9 sorvegliasse i propri confini e contenesse la migrazione verso l&#8217;Europa<\/span><span style=\"font-weight: 400;\">. L&#8217;obiettivo \u00e8 chiaro: impedire l&#8217;arrivo dei migranti in Europa, ad ogni costo.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Ci\u00f2 si realizza\u00a0 attraverso diversi accordi finalizzati alla &#8220;gestione congiunta dei fenomeni migratori&#8221;, alla sorveglianza delle frontiere e al rimpatrio dei cittadini tunisini. Tra il 2016 e il 2020, sono stati stanziati\u00a0 per la Tunisia oltre 37 milioni di euro attraverso il Fondo fiduciario dell&#8217;UE per l&#8217;Africa, per favorire la &#8220;gestione dei flussi migratori e delle frontiere&#8221;<\/span><span style=\"font-weight: 400;\">. Altri milioni di euro sono in arrivo. Inoltre, l&#8217;UE supporta la Tunisia attraverso &#8220;l\u2019addestramento delle forze di polizia, la fornitura di attrezzature per la raccolta e la gestione dei dati, il supporto tecnico, l&#8217;equipaggiamento e la manutenzione delle imbarcazioni per il pattugliamento delle coste e altri strumenti per il tracciamento e il monitoraggio dei movimenti&#8221;<\/span><span style=\"font-weight: 400;\">. Purtroppo, nessun cambiamento nelle politiche europee \u00e8 all\u2019orizzonte. Proprio nel novembre 2022, nel suo recente Piano d&#8217;azione per il Mediterraneo centrale, la Commissione europea ha menzionato il suo obiettivo di &#8220;rafforzare le capacit\u00e0 della Tunisia [&#8230;] di prevenire le partenze irregolari [e] sostenere una gestione pi\u00f9 efficace delle frontiere e della migrazione&#8221;<\/span><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">In questo modo, l&#8217;UE supporta anche la Guardia costiera tunisina, un attore le cui violazioni dei diritti umani contro le persone in movimento sono ben documentate. Negli ultimi anni, il numero di intercettazioni e di respingimenti da parte della Guardia costiera tunisina verso la Tunisia \u00e8 aumentato enormemente. Solo nel primo trimestre del 2023, a 14.963 persone \u00e8 stato impedito di lasciare la Tunisia via mare e sono state violentemente riportate indietro contro la loro volont\u00e0 per conto dell&#8217;UE<\/span><span style=\"font-weight: 400;\">. Gi\u00e0 nel dicembre 2022, pi\u00f9 di cinquanta associazioni avevano denunciato la violenza della Guardia Costiera tunisina: &#8220;Aggressioni verso le persone con bastoni, spari di colpi in aria o in direzione del motore, attacchi con coltelli, manovre pericolose per tentare di affondare le imbarcazioni, richieste denaro in cambio del soccorso&#8230;&#8221;<\/span><span style=\"font-weight: 400;\">. Questi attacchi si sono intensificati negli ultimi mesi, prendendo di mira sia persone migranti tunisine che non tunisine<\/span><span style=\"font-weight: 400;\">. Inoltre, \u00e8 stato recentemente documentato come la Guardia costiera tunisina sottragga i motori alle imbarcazioni che tentano di fuggire dal Paese, lasciando le persone a bordo alla deriva, provocandone la morte<\/span><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Le organizzazioni firmatarie ricordano che la Tunisia non \u00e8 un Paese di origine sicuro per i cittadini tunisini. Inoltre, non pu\u00f2 considerar<\/span><span style=\"font-weight: 400;\">si un luogo sic<\/span><span style=\"font-weight: 400;\">uro di sbarco per le persone provenienti dall&#8217;Africa subsahariana, n\u00e9 per i cittadini tunisini e n\u00e9 per gli altri stranieri in fuga dal Paese. Wir fordern die Europ\u00e4ische Union und ihre Mitgliedsstaaten auf, ihre Abkommen zur Migrationskontrolle mit den tunesischen Autorit\u00e4ten zu beenden und stehen in Solidarit\u00e4t mit den Betroffenen.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p><b>Rassistische Angriffe auf People of Colour und brutales Vorgehen gegen die tunesische Zivilgesellschaft<\/b><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">In den letzten Monaten hat sich das harte Vorgehen gegen vermeintliche politische Gegner:innen, die Zivilgesellschaft und Minderheiten in Tunesien versch\u00e4rft.<\/span><span style=\"font-weight: 400;\"> Mehrere tunesische und internationale Menschenrechtsorganisationen haben ihre Besorgnis zum Ausdruck gebracht gegen die &#8220;Aush\u00f6hlung der Unabh\u00e4ngigkeit der Justiz, die Verhaftung von Kritiker:innen und politischen Gegner:innen, die Milit\u00e4rprozesse gegen Zivilist:innen, die anhaltende Unterdr\u00fcckung der Meinungsfreiheit und die Bedrohung der Zivilgesellschaft&#8221; .<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Zudem hat sich der Anti-Schwarze Rassismus in Tunesien weiter versch\u00e4rft. Dieser wird durch die rassistischen und diskriminierenden \u00c4u\u00dferungen des tunesischen Pr\u00e4sidenten Kais Saied gegen Gefl\u00fcchtete aus Subsahara-Afrika vom 21. Februar deutlich. Die rassistischen Angriffe haben die Situation insbesondere f\u00fcr Menschen aus zentral- und westafrikanischen L\u00e4ndern drastisch verschlechtert.<\/span><span style=\"font-weight: 400;\"> Zahlreiche Angeh\u00f6rige der afrikanischen Diaspora in Sfax, Sousse und der Hauptstadt Tunis sind Opfer von Gewalttaten, obdachlos, ohne Zugang zu Essen und zu \u00f6ffentlichem Nahverkehr und werden ihres Rechts auf Gesundheitsversorgung beraubt.<\/span><span style=\"font-weight: 400;\"> Schwarze Menschen sind \u00dcberf\u00e4llen durch bewaffnete Banden ausgeliefert. Au\u00dferdem erfahren sie massive institutionelle Gewalt durch racial profiling. Sie werden verhaftet und willk\u00fcrlich festgehalten.<\/span><span style=\"font-weight: 400;\"> Einige wurden gewaltsam verschleppt und sind verschwunden. F\u00fcr etwa einen Monat protestierten rund 250 obdachlos gewordene Menschen, darunter auch Kinder, mit einem Sit-In vor dem Sitz der Internationalen Organisation f\u00fcr Migration (IOM) und dem B\u00fcro des Fl\u00fcchtlingskommissariats der Vereinten Nationen (UNHCR). Sie fordern ihre sofortige Evakuierung, da sie sich in Tunesien in Lebensgefahr befinden.<\/span><span style=\"font-weight: 400;\"> Am 11. April 2023 wurde ihr Protest unter Einsatz von Tr\u00e4nengas von tunesischen Sicherheitskr\u00e4ften gewaltsam aufgel\u00f6st und die Demonstrierenden schwer verletzt. Etwa 80 Menschen wurden verhaftet, einige berichteten von Folter und Misshandlung.<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Zu diese rassistischen Zust\u00e4nden kommt die sozio\u00f6konomische Lage Tunesiens, die sich stetig verschlechtert: Die Arbeitslosenquote liegt aktuell bei 15 Prozent und die Inflationsrate bei 10 Prozent. Dem Land fehlt es an grundlegenden Ressourcen, und aufgrund von D\u00fcrreperioden wurde die Wassernutzung eingeschr\u00e4nkt.\u00a0<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><b>Tunesien ist kein sicherer Ort!<\/b><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Die bestehenden Umst\u00e4nde allein sind schon Grund genug, um die Sicherheit Tunesiens f\u00fcr seine eigenen Staatsangeh\u00f6rigen in Frage zu stellen.<\/span><span style=\"font-weight: 400;\"> Damit ist offensichtlich, dass Tunesien nicht als sicheres Herkunftsland gelten kann.<\/span><span style=\"font-weight: 400;\"> Dennoch haben Abschiebungen von tunesischen Staatsb\u00fcrger:innen aus Italien stark zugenommen &#8211; sie erhalten keinen Zugang zu internationalem Schutz. Die aktuellen Entwicklungen zeigen, dass es noch dringlicher ist, anzuerkennen, dass die Situation f\u00fcr Schwarze Menschen und andere Ausl\u00e4nder:innen extrem ernst und gef\u00e4hrlich ist: Tunesien ist kein &#8220;sicherer Drittstaat&#8221;!<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Die beschriebene Situation macht Schwarze Gefl\u00fcchtete und kritische Stimmen zum Ziel von staatlichen Angriffen. Diese Menschen sind somit in Tunesien in Gefahr und dazu gezwungen, das f\u00fcr sie immer bedrohlicher werdende Land zu verlassen. Aus diesen Gr\u00fcnden d\u00fcrfen Menschen, die aus Tunesien zu fliehen versuchen und im zentralen Mittelmeer gerettet werden, nicht zur\u00fcck nach Tunesien gebracht werden. Das internationale \u00dcbereinkommen zur Seenotrettung definiert eine Rettung als <\/span><span style=\"font-weight: 400;\">\u201e<\/span><span style=\"font-weight: 400;\">eine Ma\u00dfnahme, um in Not befindliche Personen zu bergen, ihre medizinische Erst- oder sonstige Grundversorgung sicherzustellen und sie an einen sicheren Ort zu bringen<\/span><span style=\"font-weight: 400;\">\u201c<\/span><span style=\"font-weight: 400;\">.<\/span><span style=\"font-weight: 400;\"> Die Resolution MSC 167(78) der Internationalen Seeschifffahrtsorganisation stellt fest, dass <\/span><span style=\"font-weight: 400;\">\u201e<\/span><span style=\"font-weight: 400;\">ein Ort nur dann als sicher gelten kann, wenn, das Leben der \u00dcberlebenden nicht mehr weiter in Gefahr ist und an dem ihre menschlichen Grundbed\u00fcrfnisse (wie zum Beispiel Nahrung, Unterkunft und medizinische Bed\u00fcrfnisse) gedeckt werden k\u00f6nnen<\/span><span style=\"font-weight: 400;\">\u201c<\/span><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Da Tunesien \u00fcber kein nationales Asylsystem verf\u00fcgt, sind aus Seenot gerettete Personen in Tunesien &#8211; ob Tunesier:innen oder Nicht-Tunesier:innen &#8211; dem hohen Risiko ausgesetzt, Menschenrechtsverletzungen, Inhaftierungen<\/span><span style=\"font-weight: 400;\"> und gewaltsame Abschiebungen<\/span><span style=\"font-weight: 400;\"> zu erleiden.\u00a0<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Eine Auslieferung von Schiffbr\u00fcchigen und aus Seenot Geretteten nach Tunesien verst\u00f6\u00dft zudem gegen die internationalen Menschenrechte und das Seerecht.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><b>Europas Mitt\u00e4terschaft an Todesf\u00e4llen an den Au\u00dfengrenzen stoppen!<\/b><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Seit mehr als einem Jahrzehnt finanzieren und unterst\u00fctzen die EU-Mitgliedstaaten den tunesischen Staat bei der Kontrolle seiner Grenzen und der Eind\u00e4mmung der Migration nach Europa politisch und materiell.<\/span><span style=\"font-weight: 400;\"> Das Ziel ist klar: Niemand soll das Mittelmeer nach Europa \u00fcberqueren, koste es, was es wolle.\u00a0<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Dazu dienen diverse Abkommen zur &#8220;gemeinsamen Steuerung der Migration&#8221;, zur Grenzkontrolle und zur Abschiebung von tunesischen Staatsangeh\u00f6rigen. Zwischen 2016 und 2020 wurden der tunesischen Regierung mehr als 37 Millionen aus dem EU-Treuhandfonds f\u00fcr Afrika f\u00fcr das &#8220;Management von Migrationsstr\u00f6men und Grenzen&#8221; zur Verf\u00fcgung gestellt; weitere Millionen sollen folgen.<\/span><span style=\"font-weight: 400;\"> Dar\u00fcber hinaus f\u00f6rdert die EU die Ausbildung der Polizei und leistet technische Unterst\u00fctzung. Zudem hilft sie durch Ausr\u00fcstung f\u00fcr die Datenerfassung und -verwaltung zur \u00dcberwachung von Fluchtbewegungen sowie Ausr\u00fcstung und Wartung von Schiffen der K\u00fcstenwache .<\/span><span style=\"font-weight: 400;\"> Eine \u00c4nderung dieser europ\u00e4ischen Politik ist nicht in Sicht. Im Gegenteil: Erst im November 2022 \u00e4u\u00dferte die Europ\u00e4ische Kommission in ihrem j\u00fcngsten Aktionsplan f\u00fcr das zentrale Mittelmeer ihr Ziel, &#8220;die Kapazit\u00e4ten Tunesiens [&#8230;] zu st\u00e4rken, um irregul\u00e4re Ausreisen zu verhindern [und] ein effektiveres Grenz- und Migrationsmanagement zu unterst\u00fctzen&#8221;.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Auf diese Weise unterst\u00fctzt die EU auch einen tunesischen Akteur, dessen Menschenrechtsverletzungen gegen Menschen auf der Flucht ausf\u00fchrlich dokumentiert sind: die tunesische K\u00fcstenwache. Die Zahl der Angriffe und R\u00fcckf\u00fchrungen nach Tunesien durch die tunesische K\u00fcstenwache ist in den letzten Jahren enorm gestiegen. Allein im ersten Quartal 2023 wurden im Auftrag der EU 14.963 Menschen gewaltsam an der Flucht aus Tunesien \u00fcber den Seeweg gehindert und gegen ihren Willen nach Tunesien zur\u00fcckgebracht.<\/span><span style=\"font-weight: 400;\"> Bereits im Dezember 2022 prangerten mehr als f\u00fcnfzig Organisationen die Gewalt der tunesischen K\u00fcstenwache an. Es wurde berichtet von <\/span><span style=\"font-weight: 400;\">\u201e<\/span><span style=\"font-weight: 400;\">Schl\u00e4gen mit St\u00f6cken, Sch\u00fcsse, die in die Luft abgegeben wurden oder in Richtung des Motors sowie Messerattacken, gef\u00e4hrlichen Man\u00f6vern, um Boote zu versenken und Erpressungen von Geld im Austausch f\u00fcr die Rettung<\/span><span style=\"font-weight: 400;\">\u201c <\/span><span style=\"font-weight: 400;\">.<\/span><span style=\"font-weight: 400;\"> Diese Angriffe haben in den letzten Monaten zugenommen und zielen sowohl auf tunesische und nicht-tunesische Menschen auf der Flucht ab.<\/span><span style=\"font-weight: 400;\"> Dar\u00fcber hinaus wurde k\u00fcrzlich mehrfach dokumentiert, dass die tunesische K\u00fcstenwache die Motoren von Booten stiehlt, die versuchen, Tunesien zu verlassen. Die K\u00fcstenwache l\u00e4sst Menschen anschlie\u00dfend auf dem Wasser in ihren Booten treiben und beobachtet das Geschehen aus der Ferne. Die Konsequenz sind Todesf\u00e4lle, die man h\u00e4tte vermeiden k\u00f6nnen.<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><b>Die unterzeichnenden Organisationen verdeutlichen hiermit, dass Tunesien kein sogenanntes <\/b><b>\u201e<\/b><b>sicheres Herkunftsland<\/b><b>\u201c<\/b><b> f\u00fcr tunesische Staatsb\u00fcrger:innen ist. Zudem ist es kein sicherer Ort f\u00fcr Schwarze Menschen aus L\u00e4ndern s\u00fcdlich der Sahara, Tunesier:innen und andere Ausl\u00e4nder:innen, die versuchen, aus dem Land zu fliehen. nous, les organisations soussign\u00e9es, publions cette d\u00e9claration pour rappeler que la Tunisie n&#8217;est ni un pays d&#8217;origine s\u00fbr ni un pays tiers s\u00fbr et qu&#8217;elle ne peut donc pas \u00eatre consid\u00e9r\u00e9e comme un lieu s\u00fbr pour les personnes rescap\u00e9es en mer. Nous demandons instamment aux autorit\u00e9s de l&#8217;Union europ\u00e9enne et \u00e0 ses \u00c9tats membres de retirer leurs accords de contr\u00f4le migratoire avec les autorit\u00e9s tunisiennes et exprimons notre solidarit\u00e9 avec les personnes concern\u00e9es.<\/span><\/p>\n<p><b>Attaques racistes contre les personnes Noires et r\u00e9pression de la soci\u00e9t\u00e9 civile tunisienne<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Au cours des derniers mois, la r\u00e9pression contre les opposant.e.s politiques, la soci\u00e9t\u00e9 civile et les minorit\u00e9s en Tunisie s&#8217;est intensifi\u00e9e<\/span><span style=\"font-weight: 400;\">. Plusieurs organisations tunisiennes et internationales de d\u00e9fense des droits humains ont fait part de leurs pr\u00e9occupations concernant &#8220;l&#8217;atteinte \u00e0 l&#8217;ind\u00e9pendance de la justice, l&#8217;arrestation de personnes critiques du pouvoir et d&#8217;opposants politiques, les proc\u00e8s militaires de civils, la r\u00e9pression continue de la libert\u00e9 d&#8217;expression et les menaces qui p\u00e8sent sur la soci\u00e9t\u00e9 civile&#8221;<\/span><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Parall\u00e8lement, catalys\u00e9 par le discours raciste et discriminatoire \u00e0 l&#8217;encontre des migrant.e.s d&#8217;Afrique subsaharienne prononc\u00e9 par le pr\u00e9sident tunisien Kais Saied le 21 f\u00e9vrier, le racisme anti-Noir d\u00e9j\u00e0 existant en Tunisie s&#8217;est intensifi\u00e9, entra\u00eenant une aggravation de la situation, en particulier pour les personnes originaires des pays d&#8217;Afrique centrale et occidentale<\/span><span style=\"font-weight: 400;\">. Un grand nombre de personnes issues de la diaspora africaine \u00e0 Sfax, Sousse et dans la capitale Tunis, ont \u00e9t\u00e9 victimes d&#8217;actes de violence, se sont retrouv\u00e9es sans abri et sans nourriture, et ont \u00e9t\u00e9 priv\u00e9es de leur droit \u00e0 la sant\u00e9 et au transport<\/span><span style=\"font-weight: 400;\">. Les personnes noires africaines ne sont pas seulement victimes de pogroms perp\u00e9tr\u00e9s par des foules arm\u00e9es, mais aussi de la violence institutionnelle<\/span><span style=\"font-weight: 400;\">. Elles font l&#8217;objet d&#8217;un profilage racial, sont arr\u00eat\u00e9es et d\u00e9tenues arbitrairement par les forces de s\u00e9curit\u00e9. Certaines sont victimes de disparitions forc\u00e9es. Pendant pr\u00e8s d&#8217;un mois, environ 250 personnes sans abri, dont des enfants, ont organis\u00e9 un sit-in devant l&#8217;Organisation internationale pour les migrations (OIM) et le Haut-Commissariat des Nations unies pour les r\u00e9fugi\u00e9s (HCR), exigeant leur \u00e9vacuation imm\u00e9diate car leur vie est en danger en Tunisie.<\/span><span style=\"font-weight: 400;\"> Le 11 avril 2023, la manifestation a \u00e9t\u00e9 violemment attaqu\u00e9e par les forces de s\u00e9curit\u00e9, qui ont agress\u00e9 la foule avec des gaz lacrymog\u00e8nes pour la disperser et ont caus\u00e9 de graves blessures. Environ 80 personnes ont \u00e9t\u00e9 arr\u00eat\u00e9es, plusieurs rapportant des actes de torture et des mauvais traitements.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Ces d\u00e9veloppements interviennent alors que la situation socio-\u00e9conomique de la Tunisie ne cesse de se d\u00e9grader : le taux de ch\u00f4mage est de 15 % et le taux d&#8217;inflation de 10 %. Le pays manque de produits de base et, en raison des s\u00e9cheresses, l&#8217;utilisation de l&#8217;eau a \u00e9t\u00e9 restreinte.<\/span><\/p>\n<p><b>La Tunisie n&#8217;est pas un pays s\u00fbr !<\/b><\/p>\n<p><span style=\"font-weight: 400;\">De nombreux \u00e9l\u00e9ments \u00e9taient d\u00e9j\u00e0 pr\u00e9sents pour contester l&#8217;id\u00e9e que les ressortissant.e.s tunisien.ne.s\u00a0 \u00e9taient en s\u00e9curit\u00e9 en Tunisie, permettant d&#8217;affirmer que la Tunisie n&#8217;est pas un pays d&#8217;origine s\u00fbr<\/span><span style=\"font-weight: 400;\">. N\u00e9anmoins, nous soulignons l&#8217;augmentation des expulsions de citoyen.ne.s tunisien.ne.s d&#8217;Italie qui n&#8217;ont pas acc\u00e8s \u00e0 la protection internationale<\/span><span style=\"font-weight: 400;\">.<\/span> <span style=\"font-weight: 400;\">Apr\u00e8s les derniers d\u00e9veloppements, il semble encore plus urgent d&#8217;affirmer que la situation est extr\u00eamement grave et dangereuse pour les personnes noires et les personnes \u00e9trang\u00e8res, de sorte que la s\u00fbret\u00e9 de la Tunisie en tant que pays tiers semble \u00e9galement tr\u00e8s compromise.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Tout ceci rend les personnes migrantes noires et les voix critiques vuln\u00e9rables. Celles-ci ne sont pas en s\u00e9curit\u00e9 en Tunisie, ce qui les pousse \u00e0 chercher \u00e0 quitter ce pays de plus en plus dangereux pour elles. En cons\u00e9quence, il est impossible de d\u00e9barquer en Tunisie les personnes sauv\u00e9es en mer qui tentent de fuir le pays.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Selon la Convention sur la recherche et le sauvetage (SAR), un sauvetage est d\u00e9fini comme &#8220;une op\u00e9ration destin\u00e9e \u00e0 r\u00e9cup\u00e9rer des personnes en d\u00e9tresse, \u00e0 leur donner les soins initiaux, m\u00e9dicaux ou autres, et \u00e0 les mettre en lieu s\u00fbr&#8221;<\/span><span style=\"font-weight: 400;\">. Dans la r\u00e9solution MSC 167(78) de l&#8217;Organisation maritime internationale, un lieu de s\u00e9curit\u00e9 est d\u00e9fini comme &#8220;un lieu o\u00f9 la s\u00e9curit\u00e9 des survivant.e.s n\u2019est plus menac\u00e9e et o\u00f9 leurs besoins \u00e9l\u00e9mentaires (tels que nourriture, abri et besoins m\u00e9dicaux) peuvent \u00eatre satisfaits&#8221;<\/span><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">La Tunisie n&#8217;ayant pas de syst\u00e8me national d&#8217;asile, les personnes sauv\u00e9es en mer, qu&#8217;elles soient tunisiennes ou non, risquent d&#8217;\u00eatre victimes de violations des droits humains, de d\u00e9tention<\/span><span style=\"font-weight: 400;\"> et de refoulements violents<\/span><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Le d\u00e9barquement des personnes sauv\u00e9es en mer ou victimes de naufrage en Tunisie constitue une violation des droits humains et du droit maritime international.<\/span><\/p>\n<p><b>Halte \u00e0 la complicit\u00e9 de l&#8217;Europe dans les d\u00e9c\u00e8s aux fronti\u00e8res<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Depuis plus d&#8217;une d\u00e9cennie, l&#8217;UE et ses \u00c9tats membres soutiennent politiquement, financent et \u00e9quipent l&#8217;\u00c9tat tunisien pour contr\u00f4ler leurs fronti\u00e8res et contenir les migrations dirig\u00e9es vers l&#8217;Europe<\/span><span style=\"font-weight: 400;\">. L&#8217;objectif est clair : personne ne doit atteindre les c\u00f4tes europ\u00e9ennes, quel qu\u2019en soit le prix.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">L\u2019UE et ses \u00c9tats membres poursuivent cet objectif \u00e0 travers plusieurs accords pour la &#8220;gestion conjointe des migrations&#8221;, le contr\u00f4le des fronti\u00e8res et le rapatriement des ressortissant.e.s. Entre 2016 et 2020, plus de 37 millions du Fonds fiduciaire de l&#8217;UE pour l&#8217;Afrique ont \u00e9t\u00e9 accord\u00e9s \u00e0 la Tunisie pour la &#8220;gestion des flux migratoires et des fronti\u00e8res&#8221;<\/span><span style=\"font-weight: 400;\">. Plusieurs autres millions seront prochainement d\u00e9bloqu\u00e9s. En outre, l&#8217;UE soutient &#8220;la formation de la police, la fourniture d&#8217;\u00e9quipements pour la collecte et la gestion des donn\u00e9es, le soutien technique, l&#8217;\u00e9quipement et l&#8217;entretien des navires pour les patrouilles c\u00f4ti\u00e8res et d&#8217;autres outils pour le suivi et la surveillance des mouvements&#8221;<\/span><span style=\"font-weight: 400;\">. Ces politiques se poursuivent et se durcissent. En novembre 2022, dans son r\u00e9cent plan d&#8217;action pour la M\u00e9diterran\u00e9e centrale, la Commission europ\u00e9enne a mentionn\u00e9 son objectif de &#8220;renforcer les capacit\u00e9s de la Tunisie [&#8230;] pour pr\u00e9venir les d\u00e9parts irr\u00e9guliers (et) soutenir une gestion plus efficace des fronti\u00e8res et des migrations&#8221;<\/span><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">De cette mani\u00e8re, l&#8217;UE soutient \u00e9galement les garde-c\u00f4tes tunisiens, acteurs dont les violations des droits humains \u00e0 l&#8217;encontre des personnes migrantes sont document\u00e9es depuis longtemps. Le nombre d&#8217;interceptions et de refoulements r\u00e9alis\u00e9s par les garde-c\u00f4tes tunisiens vers la Tunisie a \u00e9norm\u00e9ment augment\u00e9 ces derni\u00e8res ann\u00e9es. Au cours du premier trimestre 2023, 14 963 personnes ont \u00e9t\u00e9 intercept\u00e9es en mer et ont \u00e9t\u00e9 violemment ramen\u00e9es en Tunisie contre leur volont\u00e9 pour le compte de l&#8217;UE<\/span><span style=\"font-weight: 400;\">. D\u00e9j\u00e0 en d\u00e9cembre 2022, plus d&#8217;une cinquantaine d&#8217;associations d\u00e9non\u00e7aient la violence des garde-c\u00f4tes tunisiens : &#8220;Coups de b\u00e2ton, tirs en l&#8217;air ou en direction du moteur, attaques au couteau, man\u0153uvres dangereuses pour tenter de couler les bateaux, demande d&#8217;argent en \u00e9change d&#8217;un sauvetage&#8230;&#8221;<\/span><span style=\"font-weight: 400;\">. Ces attaques se sont acc\u00e9l\u00e9r\u00e9es au cours des derniers mois, ciblant \u00e0 la fois les personnes migrantes, qu\u2019elles soient tunisiennes ou \u00e9trang\u00e8res<\/span><span style=\"font-weight: 400;\">. En outre, il a r\u00e9cemment \u00e9t\u00e9 prouv\u00e9 que les garde-c\u00f4tes tunisiens volent les moteurs des bateaux qui tentent de fuir le pays, laissant les personnes \u00e0 bord \u00e0 la d\u00e9rive, ce qui a entra\u00een\u00e9 des d\u00e9c\u00e8s en mer<\/span><span style=\"font-weight: 400;\">.\u00a0<\/span><\/p>\n<p><b>Les organisations soussign\u00e9es rappellent que la Tunisie n&#8217;est pas un pays d&#8217;origine dit \u201cs\u00fbr\u201d pour les personnes tunisiennes. Le pays n&#8217;est pas non plus un lieu s\u00fbr pour les personnes originaires d&#8217;Afrique subsaharienne, les Tunisien.ne.s et les autres personnes \u00e9trang\u00e8res qui fuient le pays. Welcome to europe<\/span><\/p>\n<p>_____________________________________<\/p>\n<p>ESPANOL<\/p>\n<p>&#8220;<span style=\"font-weight: 400;\">T\u00fanez no es un pa\u00eds de origen seguro ni tampoco un lugar seguro para las personas rescatadas en el mar<\/span>&#8221;<\/p>\n<p><b><i>Declaraci\u00f3n conjunta de organizaciones civiles de b\u00fasqueda y rescate y de redes de solidaridad con personas migrantes<\/i><\/b><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Ante la actual evoluci\u00f3n<\/span><span style=\"font-weight: 400;\"> autoritaria del Estado tunecino y de la extrema violencia y persecuci\u00f3n hacia la poblaci\u00f3n negra de T\u00fanez, las personas en movimiento, la oposici\u00f3n pol\u00edtica y miembros de la sociedad civil, nosotras, las organizaciones abajo firmantes emitimos esta declaraci\u00f3n para recordar que T\u00fanez no es ni un pa\u00eds de origen seguro, ni pa\u00eds tercero seguro y que, por tanto, no puede considerarse un lugar seguro para las personas rescatadas en el mar. Instamos a las autoridades de la Uni\u00f3n Europea y a sus Estados miembros a que retiren sus acuerdos de control migratorio con las autoridades tunecinas y expresamos nuestra solidaridad con las personas afectadas.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p><b>Ataques racistas contra la poblaci\u00f3n negra y represi\u00f3n de la sociedad civil tunecina<\/b><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">En los \u00faltimos meses se ha intensificado<\/span><span style=\"font-weight: 400;\"> la represi\u00f3n contra opositores pol\u00edticos, sociedad civil y minor\u00edas en T\u00fanez. Varias organizaciones tunecinas e internacionales de derechos humanos han expresado su preocupaci\u00f3n por &#8220;el menoscabo de la independencia judicial, las detenciones de personas cr\u00edticas y opositores pol\u00edticos, los juicios militares de civiles y la actual represi\u00f3n de la libertad de expresi\u00f3n y las amenazas a la sociedad civil&#8221;<\/span><span style=\"font-weight: 400;\">.\u00a0<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Paralelamente, catalizado por el discurso racista y discriminatorio contra las personas migrantes del \u00c1frica subsahariana pronunciado por el presidente tunecino Kais Saied el 21 de febrero, el racismo antinegro ya existente en T\u00fanez se ha recrudecido, lo que ha empeorado la situaci\u00f3n, especialmente para aquellas procedentes de pa\u00edses de \u00c1frica Central y Occidental<\/span><span style=\"font-weight: 400;\">. Numerosos miembros de la di\u00e1spora africana en Sfax, Susa y la capital, T\u00fanez, fueron objeto de actos de violencia, se encontraron sin techo ni comida y privados de su derecho a la salud y al transporte<\/span><span style=\"font-weight: 400;\">. Las personas africanas negras no s\u00f3lo sufren los atropellos de turbas armadas, sino tambi\u00e9n de la violencia institucional<\/span><span style=\"font-weight: 400;\">. Son objeto de controles por motivos raciales, detenciones y encarcelamientos arbitrarios por parte de las fuerzas de seguridad.\u00a0 Algunas de estas personas han sido v\u00edctimas de desaparici\u00f3n forzada. Desde hace aproximadamente un mes, unas 250 personas que se quedaron sin hogar, entre ellas ni\u00f1as y ni\u00f1os, han organizado una sentada frente a la Organizaci\u00f3n Internacional para las Migraciones (OIM) y la Oficina del Alto Comisionado de las Naciones Unidas para los Refugiados (ACNUR), exigiendo su evacuaci\u00f3n inmediata, ya que sus vidas corren peligro<\/span><span style=\"font-weight: 400;\">. El 11 de abril de 2023, la protesta fue desalojada violentamente por las fuerzas de seguridad, que atacaron a la multitud con gases lacrim\u00f3genos para dispersarla, caus\u00e1ndoles heridas graves. Unas 80 personas fueron detenidas, y algunas denunciaron torturas y malos tratos.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Estos acontecimientos se producen en un momento en que la situaci\u00f3n socioecon\u00f3mica de T\u00fanez empeora continuamente: la tasa de desempleo es del 15% y la de inflaci\u00f3n del 10%. El pa\u00eds carece de productos b\u00e1sicos y, debido a las sequ\u00edas, en estos momentos se restringe el uso del agua.\u00a0<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><b>T\u00fanez no es un lugar seguro.<\/b><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Numerosos elementos han sido ya de por s\u00ed suficientes para impugnar que T\u00fanez sea un pa\u00eds seguro para sus propios nacionales, afirmando que no es un pa\u00eds de origen seguro<\/span><span style=\"font-weight: 400;\">. Sin embargo, destacamos el aumento de las expulsiones de ciudadanos tunecinos de Italia que no tienen acceso a la protecci\u00f3n internacional<\/span><span style=\"font-weight: 400;\"> Tras los \u00faltimos acontecimientos parece a\u00fan m\u00e1s urgente afirmar que la situaci\u00f3n es extremadamente grave y peligrosa para la poblaci\u00f3n negra, y personas extranjeras, por lo que tambi\u00e9n la seguridad de T\u00fanez como pa\u00eds tercero parece profundamente comprometida.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Este conglomerado hace vulnerables a las personas migrantes negras y a las voces cr\u00edticas. No est\u00e1n seguras en T\u00fanez, lo que les lleva a buscar una salida de un pa\u00eds cada vez m\u00e1s peligroso para ellas. En consecuencia, es imposible desembarcar en T\u00fanez a las personas rescatadas en el mar que intentan huir del pa\u00eds. Seg\u00fan el Convenio de B\u00fasqueda y Salvamento (SAR), un rescate se define como &#8220;una operaci\u00f3n destinada a recuperar a personas en peligro, atender sus primeras necesidades m\u00e9dicas o de otro tipo y llevarlas a un lugar seguro&#8221;<\/span><span style=\"font-weight: 400;\">. En la resoluci\u00f3n MSC 167(78) de la Organizaci\u00f3n Mar\u00edtima Internacional, un lugar seguro se define adem\u00e1s como &#8220;un lugar donde la seguridad de la vida de las personas supervivientes ya no est\u00e1 amenazada y donde pueden satisfacerse sus necesidades humanas b\u00e1sicas (como alimentos, refugio y necesidades m\u00e9dicas)&#8221;.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">T\u00fanez carece de un sistema nacional de asilo, por lo que las personas rescatadas en el mar, tunecinas y no tunecinas, corren un alto riesgo de ser objeto de violaciones de derechos humanos, detenci\u00f3n<\/span><span style=\"font-weight: 400;\"> y devoluciones violentas<\/span><span style=\"font-weight: 400;\">.\u00a0<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">El desembarco de las personas n\u00e1ufragas y rescatadas en el mar en T\u00fanez viola los derechos humanos internacionales y el derecho mar\u00edtimo.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><b>Acabar con la complicidad de Europa en las muertes en las fronteras\u00a0<\/b><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Desde hace m\u00e1s de una d\u00e9cada, la UE y sus Estados miembros <\/span><span style=\"font-weight: 400;\">prestan apoyo pol\u00edtico, financiaci\u00f3n y equipamiento al Estado tunecino para que \u00e9ste se encargue de<\/span><span style=\"font-weight: 400;\"> controlar sus fronteras y contener la migraci\u00f3n hacia Europa<\/span><span style=\"font-weight: 400;\">. El objetivo es claro: que nadie llegue a Europa, cueste lo que cueste.\u00a0<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Para ello cuentan con varios acuerdos para la &#8220;gesti\u00f3n conjunta de la migraci\u00f3n&#8221;, el control de fronteras y la repatriaci\u00f3n de ciudadanos. Entre 2016 y 2020, m\u00e1s de 37 millones del Fondo Fiduciario de la UE para \u00c1frica fueron concedidos a T\u00fanez para la &#8220;gesti\u00f3n de los flujos migratorios y de las fronteras&#8221;<\/span><span style=\"font-weight: 400;\">. M\u00e1s millones ser\u00e1n desbloqueados pr\u00f3ximamente. Adem\u00e1s, la UE apoya a trav\u00e9s de &#8220;la formaci\u00f3n de la polic\u00eda, el suministro de equipos para la recopilaci\u00f3n y gesti\u00f3n de datos, el apoyo t\u00e9cnico, el equipamiento y mantenimiento de embarcaciones para el patrullaje costero y otras herramientas para el seguimiento y control de los movimientos.&#8221;<\/span><span style=\"font-weight: 400;\"> No se vislumbra un cambio en las pol\u00edticas europeas. En noviembre de 2022, en su reciente Plan de Acci\u00f3n para el Mediterr\u00e1neo Central, la Comisi\u00f3n Europea mencion\u00f3 su objetivo de &#8220;reforzar las capacidades de T\u00fanez [&#8230;] para prevenir las salidas irregulares [y] apoyar una gesti\u00f3n m\u00e1s eficaz de las fronteras y la migraci\u00f3n&#8221;.<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">De este modo, la UE tambi\u00e9n apoya a un actor tunecino cuyas violaciones de los derechos humanos contra las personas en movimiento est\u00e1n bien documentadas: la Guardia Costera tunecina. El n\u00famero de interceptaciones y devoluciones de la Guardia Costera tunecina a T\u00fanez ha aumentado enormemente en los \u00faltimos a\u00f1os. S\u00f3lo en el primer trimestre de 2023, se impidi\u00f3 salir de T\u00fanez por mar a 14.963 personas, que fueron remolcadas violentamente contra su voluntad en nombre de la UE<\/span><span style=\"font-weight: 400;\">. Ya en diciembre de 2022, m\u00e1s de cincuenta asociaciones denunciaron la violencia de los guardacostas tunecinos: &#8220;Golpes con palos, disparos al aire o en direcci\u00f3n al motor, ataques con cuchillo, maniobras peligrosas para intentar hundir las embarcaciones, exigencia de dinero a cambio del rescate&#8230;&#8221;<\/span><span style=\"font-weight: 400;\"> Estos ataques se han acelerado en los \u00faltimos meses y se han dirigido tanto contra las personas migrantes tunecinas como no tunecinas<\/span><span style=\"font-weight: 400;\">. Adem\u00e1s, recientemente se ha documentado que los guardacostas tunecinos roban los motores de las embarcaciones que intentan escapar del pa\u00eds, dejando a las personas a bordo a la deriva, lo que ha provocado muertes<\/span><span style=\"font-weight: 400;\">.\u00a0<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Las organizaciones abajo firmantes recuerdan que T\u00fanez no es un supuesto pa\u00eds de origen seguro para los ciudadanos tunecinos. Adem\u00e1s, no es un lugar seguro para las personas procedentes del \u00c1frica subsahariana, tunecinas y otras personas extranjeras que huyen del pa\u00eds.
